A Brief Description of Zoning
Zoning establishes the types of land uses permitted on a specific tract of land.

Zoning districts are established with specific allowed land uses that vary from district to district. Some uses are permitted in a specific district as a matter of right, and others require a Specific Use Permit.

Each zoning district also has a set of development regulations that govern building size and height, yard sizes and setback distances, and size and layout of lots and other essential elements of development such as appropriate signage, landscaping, screening, and parking regulations.

Zoning is a means of promoting public health, safety, and general welfare. The authority to zone is granted to Texas cities by the state, and the process by which zoning is accomplished is spelled out in the Texas statutes.

Zoning Districts in Mount Pleasant
The City of Mount Pleasant is a zoned community and is divided into 13 districts or zones. Specific information about the city's zoning is found in Section 155: Zoning Code, of Title XV: Land Usage, of the City of Mount Pleasant's Code of Ordinances.
  1. FD: Future Development District
  2. SF-1: Single Family 1 Residential District
  3. SF-2: Single Family 2 Residential District
  4. TF: Two-Family Residential District
  5. MF: Multi-Family Residential District
  6. MH: Mobile Home District
  7. NS: Neighborhood Service
  8. GR: General Retail District
  9. CB: Central Business District
  10. C: Commercial District
  11. LI: Light Industrial District
  12. HI: Heavy Industrial District
  13. PD: Planned Development District

Procedures for Determining the Zoning Classification of a Property

The official zoning map is kept in the office of the planning department. It is best to call or stop by the planning department to determine the actual zoning of your property. You must have the legal description (lot, block and addition) of your property and the names of the streets bounding the block where the property is located. If you do not know this information, you can find it and obtain a copy of the plat at the Titus County Appraisal District located at 2404 W. Ferguson, or call (903) 572-7939.

Special Zoning Districts
There are basically two types of special zoning districts.
  • Planned development district
    Planned development zoning is most often used when an applicant's proposal does not fit neatly into the existing zoning ordinance. The creation of a planned development district results in special restrictions or allowances that are only applicable within that particular district. A piece of property must meet certain requirements to be considered for a planned development district. The planning department can help determine whether this zoning would be appropriate.
  • Specific use permits
    This specialized form of zoning allows a use that may be appropriate in some locations in a given district, but not in all locations. These specific use requests must be approved by the city council.

Applying for a Zoning Change
Only three entities may initiate a rezoning: the city council, the planning and zoning commission or a property owner or his agent. Someone other than the property owner may apply for a zoning change; however, permission of the property owner is required. In those cases where the owner is not the applicant, the owner will be required to sign an authorization form whereby the owner gives permission to an authorized agent. In all cases, the owner's signature must be on the application.

An application cut-off date has been designated for each planning and zoning commission meeting. Any application submitted after the cut-off date will be scheduled for the next month's meeting. Please call the planning office for the cut-off dates applicable to each scheduled meeting.

Rezoning Procedure

The zoning of a specific piece of property can be changed only through a public hearing process held before the planning and zoning commission and then the city council. A property owner who wishes to use his land for purposes other than those permitted by the current zoning classification, may request a zoning change.

The rezoning process outlined below allows public participation from the applicant, interested citizens, and decision makers.
  1. Contact the planning department
    An applicant seeking a change in zoning must contact the planning department to discuss the appropriate zoning before submitting an application. The request is reviewed and discussed with the applicant as to its conformance with the comprehensive plan and other adopted guidelines of the city.
  2. Application and fee
    Submit a Zoning Change Application and the $250.00 fee to the planning department. A survey and/or plat of the property showing boundary dimensions, adjacent property not separated by a street or alley, and all existing buildings on the subject property is required as part of the application. The planning department reviews the application and makes its recommendation to the planning and zoning commission.
  3. Public notification and notification of surrounding property owners
    • Public notification - Notice of the public hearings before the planning and zoning commission and the city council will be published one time in the local newspaper 15 days prior to the public hearing date.
    • Notification of surrounding property owners - 15 days prior to the date of public hearings before the planning and zoning commission and the city council, written notices are sent to all property owners within 200 feet of the property to be rezoned. Also included in the notice is information concerning the public hearing before the city council.
  4. Public hearing before the planning and zoning commission
    The planning and zoning commission will consider the zoning request at a scheduled meeting. Anyone interested may speak for or against the request during the public hearing. In considering an application for rezoning, factors such as the surrounding zoning and land use, appropriateness of the activity at the subject location, and provisions for buffering between incompatible land uses are taken into account. After reviewing the case the planning and zoning commission may approve, approve with amendments, table, or deny in whole or in part, the zoning request and forward its recommendations to city council for final determination. All zoning requests are automatically scheduled for city council review.
  5. Public Hearing before city council
    The city council will hold the public hearing for the rezoning request usually one week after the planning and zoning commission hears the request. The city council may approve, deny or table the applicant's request. Action by the city council is final and the same request may not be brought before the planning and zoning commission again for one year.
